“Emily” notified her HUD subsidized property of her new employment so that the management could make income-based rent adjustments. Federal law required that the property manager give Emily at least 30 days’ notice of the change in rent. Instead, however, he informed her that her rent would be increased by several hundred dollars the day before it was due. Unable to produce such a large sum so quickly, Emily was threatened with eviction and reached out to JALA. Staff attorney James Tyer quickly contacted the property manager to inform him that he was not in compliance with federal law. The property manager declined to correct the error. JALA then notified HUD and the property’s corporate management company that further legal action would be taken if the property continued to disregard federal law. Shortly after, a corporate manager corrected Emily’s paperwork, refunded her the additional money she was asked to pay, and ensured that the property would not make such demands of future residents.
